Hodeidah Bar Association Condemns Arbitrary Actions by Bayt al-Faqih Court President

The Yemeni Bar Association in Hodeidah Governorate has strongly denounced an incident where one of its members was subjected to humiliation and barred from practicing his profession within the courtroom of the Bayt al-Faqih Primary Court by its president. This condemnation was issued in a statement released by the association on Sunday, following the receipt of an official report and a complaint filed by lawyer Ahmed Mohammed Radman Al-Alawi. According to the complaint, the court president, Judge Hashem Mohammed Ali Al-Falahi, on Saturday, August 15, 2026, verbally insulted lawyer Al-Alawi, raised his voice at him, and expelled him from the courtroom without any legal justification or cause. This occurred while Al-Alawi was performing his professional duties in a case related to an enforcement dispute pending before the aforementioned judge. The association affirmed in its statement its categorical rejection of all practices that undermine the rights of lawyers, hinder their ability to fulfill their legal duties in defending their clients, or compromise the dignity and independence of the legal profession. It stressed that respecting lawyers during the performance of their professional mission is an integral part of respecting justice and consolidating the rule of law. The association emphasized that the complementary relationship between the pillars of justice—the judiciary and the legal profession—must be based on mutual respect, free from any practices that compromise the guarantees of a fair trial or affect the proper conduct of legal proceedings. The Bar Association called upon the competent authorities to launch an urgent and transparent investigation into the incident. It requested that the complainant's testimony be heard, and that they be enabled to present their evidence and arguments. Additionally, the testimonies of witnesses present and the official report of the incident should be reviewed to determine legal responsibility and take necessary actions against those responsible. The association concluded its statement by asserting that it will not tolerate any compromise in defending the dignity and professional rights of its members, as guaranteed by the constitution and law. This commitment aims to protect the independence of the legal profession, preserve the prestige and esteemed position of the judiciary, and safeguard the mission of justice from any detrimental practices. |
